NO. 30977 Legal Notice Proposed Partial Bond Release for Green Diamond Resource Company (Hard Rock Mining Operating Permit No. 00203) The Montana Department of Environmental Quality (DEQ) has received a request for bond release for Green Diamond Resource Company (GDRC). GDRC is authorized to operate multiple rock product quarries under Operating Permit No. 00203. The Twin Creek Rock Site on which partial release is requested is located on private lands in Sections 21, 22, 27, and 28 of Township 27 North Range 26 West, approximately 42 miles west of the city of Kalispell in Flathead County. DEQ currently holds a reclamation bond in the amount of $95,676. DEQ is proposing to release $38,464 and retain $57,212. The decrease in the bond amount is due to completion of reclamation activities performed by the operator, which includes grading, laying down soil, and reseeding quarry areas on a portion of the permitted site. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. This permitting action authorizes discharge of treated wastewater to ground water. The proposed permit supports LCWSD’s plan to update and expand LCWSD’s wastewater treatment facility to accept, treat, and handle wastewater and discharge treated wastewater to groundwater subject to permit limitations and conditions designed to protect the receiving groundwaters and downgradient state waters. Concurrent with this proposed permit, LCWSD proposes to build and operate a wastewater treatment plant where wastewater will undergo treatment and on-site disposal. Wastewater treatment may include use of advanced treatment levels with sequencing batch reactor technology with biochemical nutrient reduction (or similar). DEQ recognizes that in comparison to conventional septic treatment, the proposed treatment system provides a higher level of treatment for nutrients. The proposed facility will use rapid infiltration basins (Outfalls 001, 002, and 003) to discharge treated wastewater to underlying groundwater. The facility’s proposed location is: Township 27N, Range 21W, Section 11N; Flathead County; Latitude: 48.1127610º North, Longitude: -114.225111º West. On December 20, 2024, NorthWestern Corporation d/b/a NorthWestern Energy (“NorthWestern”) filed a Compliance Filing for Extension of Power Purchase Agreement with Basin Creek Equity Partners, LLC (“Compliance Filing”) with the Montana Public Service Commission (“Commission”). 2. In Final Order No. 6557c of Docket No. D2004.3.45 (“Final Order 6557c”), the Commission approved an agreement for sale and purchase of capacity and energy between NorthWestern and Basin Creek Equity Partners, LLC (the “PPA”) for a 20-year term. According to NorthWestern, the 20-year term of the PPA ends on June 30, 2026. The PPA gives NorthWestern, among other things, an option to extend the PPA for an additional five years, and NorthWestern states in the Compliance Filing that it intends to extend the PPA for five years to June 30, 2031. 3. In the Compliance Filing, NorthWestern provides an assessment of the potential advantages and disadvantages of extending the PPA for five years. NorthWestern’s assessment ultimately concludes that the benefits of extending the PPA for five years outweigh the risk of doing so. 4.
