PROJECT DESCRIPTION and SCOPE OF WORK The PER will include: an analysis of the City of Columbia Falls existing water system, including but not limited to the water mains, service lines, wells and storage tank; identification of future system needs; development of improvement alternatives; selection of preferred action items, including final capital project needs, funding sources, and projection of future operating and maintenance costs.   Following pre-design approval, the selected consultant may also be asked at the discretion of the City of Columbia Falls to assist in grant writing, develop a final construction design, prepare construction bid documents, assist in bidding, and monitoring construction activities, including related grant administration and management, as well as other engineering services. Minority and women’s business enterprises and labor surplus area firms (as determined by the U.S. Dept. of Labor) are encouraged to apply. * III. RESULTING CONTRACT The contract will require that the Respondent and all subcontractors comply with all applicable requirements of State and Federal funding agencies that will be funding the Preliminary Engineering Report. IV. SECTION 3 OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1968 Consistent with the requirements of Section 3 of the federal Housing and Community Development Act of 1968, to the greatest extent feasible, opportunities for training and employment arising in connection with project activities will be extended to local lower-income residents. GUIDELINES FOR RESPONSES Responses should include: 1. the firm’s legal name, address, and telephone number. 2. the principal(s) of the firm and their experience and qualifications. 3. the experience and qualifications of the staff to be assigned to project. 4. a description of the firm’s prior experience, including any similar projects, size of community, location, and name of a local official knowledgeable regarding the firm’s performance.   5. a description of the firm’s current work activities and how these would be coordinated with the project, as well as the firm’s anticipated availability during the term of the project; and, 6. The proposed work plan and schedule for activities to be performed. 7. Any proposed subcontractors should also be clearly identified, and their profiles described, as well. VI. COST AND AWARD PROCEDURE The City of Columbia Falls utilizes a “proposals based” selection process to negotiate a contract with the firm determined to be the most qualified at a price which is determined to be fair and reasonable. Costs will not be discussed until the top ranked respondent has been selected for contract negotiations. Interviews may or may not be held either in person or “on-line” electronically with the top ranked firms. The City of Columbia Falls reserves the right to accept or reject any and all Proposals, or parts of Proposals; waive technicalities; and to make its decision on the basis of merit, appropriateness, and any other factor. DEQ has determined that the current bonding level does not represent the present costs of compliance with the Metal Mine Reclamation Act, administrative rules adopted thereunder, and the operating permit. DEQ is proposing to increase the bond by $47,916. The bond increase is largely due to changes in fuel price, equipment rates, removal of nonmobile site equipment and updated indirect costs such as mobilization, contingency, and administration. In addition to the comprehensive bond review, DEQ is proposing to release $32,241 and retain $44,453 after both increasing the bond as a result of the comprehensive bond review and releasing bond for completed reclamation tasks. The bond release was requested by SPP for reclamation work completed at the Loon Lake Rock site and the Herrig 15 Rock site. The reclamation tasks completed include regrading and laying down soil on 0.5 acres at the Loon Lake Rock site and on 3.4 acres at the Herrig 15 Rock site. Additional reclamation includes revegetation of 4.3 acres on Loon Lake Rock site. SPP has also requested that five acres of bonded disturbance that had previously not been assigned to any site or disturbance be released as well. DEQ has determined the partial completion of reclamation, and removing the additional unused bonded disturbance, would decrease the currently required bond by $32,241, resulting in a required bond of $44,453. DEQ has determined the net effect on the bond from the increase as a result of the five year comprehensive review ($47,916) and the release request ($32,241) is a bond increase of $15,675. The procedure for adjusting bonds as a result of a comprehensive bond review is set forth in Section 82-4-338(3), MCA. Pursuant to Section 82-4-338(5), Montana Code Annotated (MCA), DEQ may not release or decrease a reclamation bond until the public has been provided an opportunity for a hearing and a hearing has been held if requested. The permittee and the public will have until April 15, 2025, to comment on these proposed changes to the bond amount. DEQ will issue a final bond determination after the comment period has expired. The permittee, or any person with an interest that may be adversely affected by DEQ’s final bond determination, may obtain a contested case hearing before the Board of Environmental Review. A written request for a hearing must be filed with DEQ within 30 days of the issuance of the final bond determination, stating the reason for the request.
